Case Win: Navigating A Breakdown In A Workplace Relationship

In a recent case, our member faced termination from their workplace under challenging circumstances. Initially, termination was not on the table, but a breakdown in the working relationship, fueled by the member’s comments on the incompetence of various decision-makers, led to this unfortunate outcome. The member felt that the relationship had deteriorated beyond repair.

During the conciliation process, both parties verbally agreed on terms, and a deed was to be drafted to reflect these terms. However, a specific clause in the deed caused discomfort for our member. This clause was outline by our case manager who assisted the member during conciliation proceedings. This clause required the member to ensure that other parties, such as their spouse, did not make disparaging comments, while the workplace’s principal would only “endeavour” to prevent others from making such remarks. Concerned about potential future legal proceedings, the case manager advised the member and their spouse to not agree on this wording.

Recognizing the member’s concerns, the workplace offered to amend the wording to an earlier version proposed by the member. This version required the member to make reasonable efforts to ensure no disparaging remarks were made by their spouse or close friends and family. Both parties agreed to this amendment, leading to a successful resolution.

As a result, the member received a payment of $4,068 and filed an F50 notice of discontinuance. Additionally, they were provided with a statement of service and an Employment Separation Certificate indicating resignation. This outcome not only provided financial compensation but also ensured that the member’s professional record remained intact.
