How NPAA Defended Against Scope of Practice Claims

Providing healthcare in remote Indigenous communities comes with unique challenges, especially when cultural considerations intersect with professional scope of practice.

A member faced an AHPRA notification after providing treatment to two children. The treatment was performed with the children's mother present and with her full consent. Despite the effectiveness of the procedure, the member's employer reported the treatment to AHPRA, alleging it was outside their scope of practice.

Concerned about the potential impact on their career, the member sought assistance from NPAA.

The assigned case manager, promptly reviewed the case, ensuring that all necessary documentation was in place. This included:

  • Documenting the mother’s consent

  • Verifying the patient relationships

  • Reviewing practice guidelines to assess the scope of practice

  • Coordinating with clinic management for additional support

After a period of three months with no contact from AHPRA, the member was informed during a discussion with their manager that AHPRA had decided not to proceed with the investigation. The member’s professional reputation remained intact, and they continued to provide care to the community. Notably, the children and their mother continued to visit the clinic and requested the member’s care, reinforcing their trust in the healthcare provided.

This outcome highlights the importance of:

  • Validating clinical judgment in complex cases

  • Maintaining trust within Indigenous communities

  • Recognising the role of cultural context in healthcare decisions

  • The necessity of thorough documentation and informed consent
