YEARS OF EXPERIENCE FINALLY COUNTED: NURSE WINS $1K BACK PAY AND CAREER PROGRESSION

NPAA Case Win: A nurse has had her prior nursing hours formally recognised for career progression, and recovered $1,000 in back pay after her employer overlooked a clear entitlement written into her EBA.


What happened?

Our member had spent years working as a nurse before moving into her current role. But when it came time for her pay increment, her employer refused to recognise those earlier hours, effectively treating her experience as if it didn’t exist. The result was stalled career progression and a pay rate that failed to reflect her true years of service.

What made the situation even more frustrating was that the answer was already there in black and white. Section 5.4 of the applicable EBA is clear: hours worked in the same nursing role count towards progression, regardless of where those hours were performed. There was no grey area. The entitlement was there, it simply hadn’t been applied.


How NPAA responded.

NPAA reviewed the EBA and the member’s employment history, then wrote directly to the employer on her behalf. Our case managers made the case plainly: the entitlement existed, it had not been applied, and it needed to be remedied. The employer reviewed the matter and agreed.

No drawn-out dispute. No tribunal. Just a well-prepared, direct approach, and a win.


The result.

Our member received $1,000 in back pay and had her prior hours formally credited, unlocking the pay increment she should have received all along. Her career progression is now back on track, and her employer is on notice that EBA entitlements apply, in full, to every member of staff.
